THEFT

If you are charged with theft, whether it be from a store or for a large value item, the consequences can be serious. Theft charges in the state system are based on the dollar value of the items involved.
 
If it is a shoplifting matter, the store is entitled to receive money in addition to the value of the item. It is critical that the actual value of the item be known. Over inflated values can result in significant increases in the offense, and may make the difference between a misdemeanor and a felony.

Theft charges also arise in federal cases. There are harsh consequences when the items involved were taken from the mail or are federal property. Often, in mail cases, the items involved are checks or credit cards. Aggravated identity theft can mean a stiff mandatory, consecutive sentence will be added to any other charge that is brought.

Theft cases take on many interesting forms. The FBI has an Art Theft Program, which investigates and prosecutes the theft of artwork. The FBI is also famous because for the warnings with regard to videos, movies and professional sports broadcasts. I have handled such copyright infringement related cases.

Another form of theft is rustling. In many western states if you steal a chicken from a store it is misdemeanor shoplifting, but if you take a live chicken from a ranch it can be felony rustling.
